Terms & Conditions

These terms are an agreement between you and AiAstra Innovations Private Limited, a company registered in India ("we", "us", "our"), covering the CryPhone mobile application, this website, and any Premium subscription. By installing or using CryPhone you accept them. If you do not accept them, uninstall the app; if you have paid within the last 14 days and have not accepted them, contact us and we will refund you.

1. What CryPhone is, and what it is not

CryPhone is an entertainment and habit-forming companion app. It reads sensors your phone already exposes and turns them into a character's reactions.

It is not a diagnostic, repair, warranty, insurance or protection product. Specifically:

• Its statements about your battery, storage, temperature or physical condition are dramatised for effect and must not be relied on for any decision about your device. A real diagnosis comes from your manufacturer.
• It cannot prevent damage, detect water, or protect anything. Installing it does not make your phone safer.
• Its phone-care suggestions are general good practice, not advice specific to your model, and following them is your own choice.
• It does not detect every event. What it can and cannot detect on each platform is set out on the home page, and we ask you to read that before deciding whether the app is what you want.

2. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use CryPhone on devices you own or control, for your own non-commercial use. You may not: copy, modify, decompile or reverse-engineer the app except where law expressly permits it; remove or obscure advertising or subscription checks; redistribute the app or a modified version of it; or use it to build a competing product.

We retain all rights in the app, its artwork, its character, its written lines, the CryPhone name and the tagline "Your Phone Have Feelings Too".

3. Direct downloads from this website

The APK offered on this site is the same build we submit to Google Play, signed by us. Two consequences you should understand before installing it:

• It does not update itself. There is no update channel outside a store. To get a new version you download and install it again. We will not silently push code to a directly-installed app.
• It has no store billing connection. Premium for a directly-installed app is bought on this website and activated with a licence key. Purchases made this way cannot be restored through Google Play or Apple, because those stores have no record of them — recovery goes through your email address and our licence system instead.

You are responsible for enabling installation from your browser on your own device. Only download CryPhone from www.cryphone.com or from an official store listing. A CryPhone APK obtained anywhere else is not ours and we cannot vouch for what is in it.

4. Premium subscriptions

4.1 What Premium includes

Unlimited AI conversations with the companion, the personalities marked Premium, extended memory (a year of history rather than a week), no advertising, advanced reminders, and premium report cards. Achievement-locked personalities are unlocked by playing, not by paying — a subscription does not grant them, and we do not sell them.

4.2 Buying through Google Play or the App Store

Prices are shown in the app in your local currency before you confirm. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours beforehand. Your account is charged for renewal within the 24 hours before the period ends.

You manage and cancel the subscription in your store account — Google Play → Subscriptions, or iOS Settings → your Apple Account → Subscriptions. We cannot cancel it for you, and neither can we refund it: refunds for store purchases are handled by Google or Apple under their own policies. If a free trial is offered, any unused portion is forfeited when you buy a subscription.

4.3 Buying on this website

A website purchase issues you a licence key in the format CRY-XXXXX-XXXXX-XXXXX, sent to the email address you gave at checkout. Payment is processed by Razorpay. The key:

• Activates Premium on up to five devices at once. You can release a device from within the app to free a slot.
• Is for your personal use. Publishing, selling or sharing a key is a breach of these terms, and we will revoke a key we find in circulation. Revocation removes Premium from every device it was on, without refund.
• Can be re-sent to the email address that bought it, from the Premium page, if you lose it.
• Is verified against our server periodically. If the app cannot reach us it keeps working on the last verified answer for a grace period, so a flight or a bad connection does not cost you what you paid for.

A website purchase is for a fixed term and does not renew itself. We keep no card or payment mandate on file, so nothing can be charged to you again without you deciding to buy again. There is nothing to cancel: on the day the term ends, Premium stops and the free version continues working. We email you a reminder about a week beforehand, and buying again from the Premium page adds a fresh term. A lifetime key never expires and is never charged again.

This is deliberately different from a store subscription, and it is worth being plain about the trade-off: you have to remember to buy again, and in exchange no money leaves your account by surprise.

4.4 Refunds on website purchases

We will refund a website purchase in full if you ask within 14 days and the licence key has been activated on no more than one device — email support@cryphone.com with the key. Beyond that, we refund where the app is broken in a way we cannot fix, and we do not refund because the app works as described and you changed your mind. Refunds return to the original payment method within the timeframe Razorpay and your bank take, typically 5–10 working days.

4.5 Price changes

We may change prices. A term you have already paid for keeps the price you paid, whatever happens to the list price — and because a website purchase does not renew, a price change cannot reach you mid-term at all; you simply see the new price if and when you choose to buy again. For store subscriptions, which do renew, a change takes effect at the next renewal and the store notifies you first, as its own rules require; you may cancel instead of accepting it. A lifetime key is unaffected by any later price change.

5. Advertising

The free version shows advertising. We do not control which specific ads Google serves. If you see an ad that is fraudulent, offensive or misrepresented, tell us and we will report it — and note that Premium removes advertising entirely, which is the only way we can guarantee you will not see a given ad.

6. Acceptable use

Do not use CryPhone to break the law. In relation to the AI companion specifically: do not attempt to make it produce content that is illegal, that sexualises minors, that harasses a real person, or that would cause harm if acted on. Do not attempt to extract our system prompts, circumvent rate limits, or automate requests. We may suspend access to the AI feature for a device that does these things, and where a paid licence is suspended for abuse we are not obliged to refund it.

7. Availability

We aim to keep the service running but we do not promise uninterrupted availability. The AI feature depends on services we do not operate — Amazon Web Services and its model providers — and can be unavailable through no fault of ours. The rest of the app is designed to work offline, and a server outage leaves you with a companion that talks from its built-in catalogue rather than an app that will not open.

We may change or discontinue features. If we discontinue a feature that is a substantial part of what Premium was sold as, we will refund the unused portion of a website subscription pro rata.

8. Disclaimers and liability

The app is provided "as is". To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for: damage to your device or its data; loss of on-device history caused by uninstalling, clearing app data, a device fault or a failed restore; loss arising from reliance on the app's statements about your device; or indirect, incidental or consequential loss. Our total liability to you, for any claim, is limited to the amount you paid us in the twelve months before the claim, or ₹1,000 if you paid nothing.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud, or your non-excludable rights as a consumer under the Consumer Protection Act, 2019 or equivalent legislation where you live.

9. Termination

You may stop using CryPhone at any time by uninstalling it, and delete everything it holds using Settings → Erase everything. We may suspend or terminate your licence if you materially breach these terms — in practice, for reselling keys or abusing the AI service. On termination, sections 2, 8 and 10 survive.

10. Governing law

These terms are governed by the laws of India, and the courts of Hyderabad, Telangana have exclusive jurisdiction — except that if you are a consumer resident elsewhere, you keep any right you have to bring proceedings in your own country's courts under its mandatory consumer law.

11. Third-party terms

Where you buy through a store, that store's terms also apply to the transaction, and Apple and Google are not parties to these terms but may enforce the provisions that concern them. Apple has no obligation to provide support for CryPhone, and any claim about the app should be directed to us rather than to Apple.

12. Changes to these terms

We may update these terms. Material changes will be notified in the app before they take effect, and continuing to use CryPhone after that date means you accept them. If you do not, cancel and uninstall — and if a change materially reduces what you paid for, tell us and we will refund the unused portion.
